E-2 Treaty Investor Visa

The E-2 Treaty Investor visa allows nationals of countries with which the United States maintains a treaty of commerce and navigation to enter and work in the U.S. based on a substantial investment in a U.S. business. This non-immigrant visa is ideal for entrepreneurs and business owners who want to develop and direct the operations of a business in the United States.

Key Requirements

Treaty Country

You must be a citizen of a country that maintains a treaty of commerce and navigation with the U.S.

Substantial Investment

The investment must be substantial relative to the business type (typically $100,000+ but varies by industry)

Business Requirements

  • Active, real operating business (not passive investments)
  • More than marginal (generates significant income or creates jobs)

Control

You must own at least 50% of the business or have operational control through a managerial position

  5. Attend visa interview
  6. Upon approval, enter the U.S. to operate your business

  • Does not directly lead to permanent residency (non-immigrant intent required)
